In your memorandum from September 29 you answer the question – specifically related to the above-mentioned alien – as posed in my memorandum dated February 26 1999 by describing the completely changed situation in the former SFRY with respect to 1986.

As discussed in the last telephone conversation it was decided in due course after consultations with IND to phrase my question somewhat more general, in order that it can be put to “1”. Within this framework I now present you with a number of questions formulated in English.

The reaction of the “1” (if possible before September 29) will, together with your memo of September 29, 1999, form the basis composing an individual official report on the person concerned.

Mr. Slobodan MITRIC

Mr. MITRIC has lived in The Netherlands since 1973, He has spent many of these years in prison, for various criminal offences. In The Netherlands, Mr. MITRIC has acquired some national publicity under his nickname ‘Karate Bob’.

Mr. MITRIC was declared persona non grata by the Dutch authorities in 1978. He has appealed to this decision and requested asylum in The Netherlands several times, but all his requests were rejected.

Mr. MITRIC has always offered resistance when the Dutch immigration officials wanted to expulse him to the SFRY. He claims to have arrived in The Netherlands in 1973 as a member of the Yugoslav intelligencer service SDP, with the task to kill a political opponent of Tito, called Vladmir Dapcevic, who lived in Brussels. He allegedly refused to do so, however, and never returned to the SFRY. Because of this alleged ‘desertion’ from the Yugoslav intelligence service, Mr. MITRIC maintains that he would either be sentenced to death (for high treason) or become the victim of an ‘accident’ if he returned to the SFYR.

On 29 April 1986 the Yugoslav authorities informed the Dutch authorities that there were no grounds to start penal proceedings against Mr. MITRIC that would result in the death penalty. On 22 Ma 1986, however, a Dutch court decided that the Dutch authorities were not allowed to expulse Mr. MITRIC to Yugoslavia, as it could not be excluded that he would become the victim of an ‘accident’.

 

It would be appreciated if you could answer the following questions.

 

1.      In the current FRY, which court is competent for trials against former members of the Yugoslav intelligence service ‘SDP’ who disobeyed orders back in 1973 and/or deserted from the service in 1973?

2.      In the current FRY, can someone still be trialed/punished for a crime committed in 1973?

3.      If the answer to question 2 is ‘yes’, is it possible to investigate whether there are currently any penal proceedings against Mr. MITRIC at the competent court?

4.      Have any former members of the Yugoslav intelligence service ‘SDP’ who disobeyed orders and/or deserted from the service in the 1970’s become the victim of an ‘accident’ (died under doubtful circumstances) in recent years?

 

Your answers to these questions, as well as any additional information, would be greatly appreciated.

CONTENTS CONVERSATION

The person concerned was active for/employed by the secret service of Servië-Montenegro. Person concerned has brought forward every time not to want to be sent back for fear of his life due to involvement with the secret service. In the iab [abbreviation for Internal Official Report] of 22-12-1999 it is stated in the last paragraph that the secret service is not interested to know who has done what in the seventies.

 

De IND [Immigration and Naturalization Department] now has better “deportation modalities” and would like to know if the opinion of the secret service about S-M, as stated in the above-mentioned internal report is unchanged, so that the person concerned can be send back.

I have agreed with the IND that after an investigation of the dossier the question will be answered at the latest on October 14, 2003.

Here are the answers to the questions put by “1’:

During the SFRY there was a Service of State Security (SDB, Sluzba Drzavne Bezbednosti). After the breakup of the SFRY into FRY, it was changed into State Security (DB, Drzavne Bezbednosti). After Milosevic was brought down, it was then changed into Security Information Agency (BIA, Bezbendosno Informativna Agencija) in Servië. Montenegro had and has its own security service. In other words during the time of Milosevic the right name is DB instead of SDB.

The BIA (www.bia.sr.gov.yu) is now under democratic control.

 

I hope that with this information you can sufficiently refute the question of the IND-GKG. Let me know if you want more details.
